Terms of Use

These terms describe access, subscriptions, content ownership, acceptable use, and the operating limits of Dive Track.

Acceptance of These Terms

These Terms of Use govern your access to and use of Dive Track. By creating an account, using Dive Track, or starting a subscription, you agree to these terms.

Dive Track Service

Dive Track helps divers plan trips, track dives, manage gear, store certifications, and maintain logbook records across supported web and mobile apps. Dive Track is a planning and recordkeeping tool. It is not a dive computer, dive training agency, emergency service, or substitute for professional instruction, dive planning, local conditions checks, or safe diving judgment.

Accounts

You are responsible for keeping your account credentials secure and for activity that occurs under your account. You agree to provide accurate account information and to update it when needed.

Free, Premium Trials, and Billing

Dive Track includes a Free plan with access to every current feature. On Free, you may create or join one trip total, save one gear set, save ten owned gear items, and save one dive computer. Existing records remain available if you reach or exceed a limit.

A genuinely new account receives a one-calendar-month Premium trial managed by Dive Track. The Premium trial requires no card, does not renew, has no next billing date, and becomes Free automatically when it ends. Creating another account after deletion may create a new trial because trial history is deleted with the account.

Paid Premium is available as monthly and annual auto-renewing plans. Billing begins immediately when you confirm a web, Apple App Store, or Google Play purchase. A paid purchase does not restart the one-month trial. Premium removes the Free plan limits while active.

Subscriptions automatically renew at the end of each billing period unless canceled before renewal. If you subscribe through Apple App Store or Google Play, manage or cancel the subscription through your Apple or Google account settings. If you subscribe through Dive Track on the web, manage or cancel through the billing portal made available in your Dive Track account.

Canceling stops future renewals, but Premium remains available through any valid paid or billing-grace period. When Premium ends, the account continues on Free; Dive Track does not delete, hide, or disable existing diver records. Refunds, if any, are handled according to the policy of Apple, Google, Stripe, and applicable law.

Your Content

You retain ownership of dive logs, trip details, media, notes, and other content you add to Dive Track. You grant Dive Track a non-exclusive, worldwide, royalty-free permission to host, process, reproduce, display, create technical formats from, and sync that content as needed to provide, secure, maintain, and improve the service, including recommendations, imports, search, planning, and account export features.

If you submit factual corrections, dive-site updates, gear catalog requests, ratings, tags, sea-life sightings, or other catalog contributions, you grant Dive Track permission to review, normalize, combine, publish, and use those factual contributions in Dive Track catalogs and product features. We may edit or decline submissions for accuracy, consistency, safety, abuse prevention, or product quality.

Aggregated Data and Catalogs

Dive Track may create aggregated or de-identified information from service activity and user-provided records, including information from dive logs, trips, gear, certifications, preferences, catalog contributions, and environmental observations. Examples include dive-site popularity, average depth, average dive duration, visibility or temperature trends, common gear setups, certification patterns, sea-life sighting trends, feature usage, product demand, and market insights. Dive Track may use, share, license, or sell that aggregated or de-identified information to operate, improve, analyze, market, and develop Dive Track, build recommendations, publish site-level or catalog-level statistics, and work with researchers, conservation organizations, dive shops, training agencies, equipment brands, travel partners, public agencies, or advertisers, provided it does not identify you or disclose your private content at an individual level.

Dive Track owns its software, workflows, data models, catalog structure, enrichment processes, recommendations, analytics, and curated catalog databases. These Terms do not transfer ownership of your personal content to Dive Track.

Where environmental observations may create conservation, safety, or site-access risk, Dive Track may generalize, withhold, or restrict exact location, timestamp, or sighting details before sharing or publishing them.

Acceptable Use

You agree not to misuse Dive Track, attempt unauthorized access, interfere with the service, upload unlawful content, or use Dive Track in a way that violates applicable law or another person's rights.

Third-Party Services

Dive Track may rely on third-party services for hosting, authentication, payments, maps, app-store billing, analytics, email, and related operations. Your use of those services may also be subject to their terms and policies.

Changes and Termination

We may update Dive Track or these Terms of Use from time to time. If changes are material, we will provide notice in a reasonable way. We may suspend or terminate access if an account violates these terms or creates risk for Dive Track or other users.
